A question we are often asked is ‘How can I fund my claim?’

This is an important question which should be considered early in any proposed litigation.

We offer a number of different funding options and which one you choose will depend on a number of factors, such as:

  • your personal financial circumstances,
  • your own preferences,
  • your attitude to risk,
  • the nature of your case,
  • the value of your claim, et cetera.

We will work closely with you to identify which option is most appropriate for you in your particular circumstances.

Ways To Fund Your Claim

• Fixed fees agreed on a stage by stage basis.

Where appropriate, we may offer fixed fees for certain elements or stages of work to be carried out on your case.

With this option, stages of work and the costs of such work are agreed between the client and the firm in advance of the work being carried out.

• Hourly rates.

With this option, you will be billed at regular intervals on the basis of the time spent by us on the
work we are required to carry out on your case.

You are billed according to our hourly rates, plus VAT.

• No win, no fee arrangement.

This option is also commonly known as a Conditional Fee Agreement (CFA). With this type of arrangement, you only pay us in the event you win your case.

We may also, in certain circumstances, offer to work on a Partial No Win No Fee Agreement or a Reduced Fee Agreement. In both cases payment to us is outcome dependent.

• Deferred fees.

In certain cases we may agree with you to defer payment until a set stage in the proceedings or at the conclusion of your case.

Payment in this case is not dependent on the outcome. This simply allows you time to pay in case cash-flow is an issue.

• Damages based agreement (DBA)

With a DBA we act on the basis that we will be paid an agreed percentage of the damages awarded from either settling your case or winning in court.

Payment to us is thus dependent on the outcome of your case.

• Third party litigation funding

In certain types of cases we are able to approach a 3rd party investor to fund the cost of your litigation.

They agree to fund the costs of your case in return for a percentage of your winnings.

• Legal expenses insurance

You may already have legal expenses insurance as part of other cover you have previously taken out, for example home (buildings or contents) insurance.

The specific terms of any policy you may have will be a factor in determining whether this is a suitable option for you.
